26 Billion More Down The Drain

It’s official. After months of challenging negotiations, government authorities announced last Thursday that they reached a $26 billion settlement with five of the nation’s biggest banks over their flawed and fraudulent foreclosure practices. The goal as it was spun to us the public was that this 26 billion dollar deal is intended to help troubled borrowers by lowering the amounts they owe on their homes and their overall mortgage payments.   So how is this deal going to work and why do I say another 26 billion down the drain? First off, 1.5 billion of the 26 billion is earmarked for some 750,000 homeowners who lost their homes to foreclosure between 2008 and 2011.   If you do the math, it’s roughly $2,000 per person.    Was I the only one in America who knew someone who just decided to stop making payments and let the bank take back their property?    In the meantime, some of these people were going on vacation instead ...

Should I Refinance My Mortgage?

These past couple of years many clients have asked about whether or not they should refinance their mortgage.    Along with people who have never refinanced, those that did even 18 months ago may be licking their chops to do the tango for another refinance in 2012.  For the week that ended December 23rd, the 30-year mortgage rate fell to 4.05% which was the lowest in 60 years according to HSH Associates which is a mortgage data firm.    The rates have gotten better in the jumbo market for those with a mortgage above $417,000 as well, but if you are below that number here are some considerations about whether a refinance is right for you. 1.) Rental Income: Here Is The Bad News

Attention owners of rental homes and properties . . . You aren’t going to like one of the tax changes that appears to be on the horizon for 2011 as part of the revenue offset of the recent Small Business Jobs and Credit Act of 2010. The legislation would require an IRS Form 1099 for rental property expense payments.  The provision would subject all recipients of rental income from real estate to the 1099 reporting requirement, with the exception for taxpayers that rent their principal residence on a temporary basis, receive minimal amount of rental income, or would experience a hardship under this provision.  This provision would give the Department of Treasury the authority to determine what constitutes a “minimal amount” of rental income and what constitutes a “hardship.”  According to JCT, this provision would increase revenue by $2.546 billion over 10 years.  (source:  www.gop.gov/bill/111/2/hr5297senateamendment) In simple terms, the bill makes recipients of rental income fall underneath the same information ...
